Offer Agreement

This Offer from the owner of the Zama VPN Internet application, hereinafter referred to as "Seller", to the user of the application services, hereinafter referred to as "Customer", is an offer to conclude a Service Agreement and defines the basic terms and conditions of providing Services via the Zama VPN Application. The Customer, acting for the purpose of purchasing the Services, accepts the terms and conditions of this Service Agreement (hereinafter referred to as the Agreement) on the following terms and conditions.

1. Definition of Terms

• 1.1 Public offer (hereinafter - Offer) - a public offer of the Seller addressed to an indefinite number of persons to conclude with the Seller a Distance Service Agreement (hereinafter - the "Agreement") on the terms and conditions contained in this Offer, including all Appendices.

• 1.2 Order - the Customer's decision to order Data Processing Service via Zama VPN Application by selecting one of the tariffs and paying for it, shall constitute full and unconditional acceptance of this Offer by the Customer.

• 1.3 The Seller provides Data Processing Services, including private virtual access services, as well as other Services related to private Internet security and private Internet access (hereinafter referred to as the Services).

• 1.4. Tariffs - a system of prices for the Services provided in the Zama VPN Application

2. General Conditions

• 2.1 The Buyer orders Data Processing Services via Zama VPN Application by selecting one of the tariffs provided in the Application. By paying for the Order, the Buyer confirms its consent to enter into this Agreement by accepting the offer.

• 2.2 By entering into the Agreement, the Buyer confirms the following:

  • a) The Buyer is fully informed and agrees with the terms and conditions of this Contract;

  • b) The Buyer authorizes the collection, processing and transfer of personal data under the conditions defined in the Privacy Policy posted on the website https://zamavpn.net.

3. Prices

• 3.1 The price for the Services is specified in the Zama VPN Application in the Tariffs section.

• 3.2 The Seller has the right to unilaterally change the price of any Tariff without notifying the Buyer.

• 3.3 The Seller may not change the price of an Order that has already been paid for by the Buyer.

• 3.4 The Buyer's obligations to pay for the Order shall be deemed to be fulfilled from the moment of receipt of funds to the Seller in accordance with the Tariffs in full.

• 3.5 Settlements between the Seller and the Buyer for the Goods may be made by the methods provided for in the Zama VPN application.

4. Ordering

• 4.1 The Services may be ordered by the Buyer in several ways:

  • a) through the Zama VPN Application;

  • b) by sending an invoice for payment to the Customer's e-mail address.

• 4.2 When ordering via the Zama VPN Application, the Customer undertakes to provide an e-mail address and is responsible for its accuracy.

• 4.3 If the Buyer fails to provide the necessary information, the Seller is not responsible for providing a quality service to the Buyer.

• 4.4 The contract between the Seller and the Buyer shall be deemed concluded from the moment the Buyer pays for the order in the Zama VPN App.

• 4.5 If the Buyer has not used the "Unsubscribe" function in the Zama VPN App, upon expiration of the initial Order, the completed Order is extended for a similar period of time in accordance with the Tariffs specified in the Zama VPN App as of the date of such extension (auto-renewal of the Services).

5. Procedure for Provision of Services

• 5.1 The Services shall be provided according to the described in the Zama VPN Application.

6. Termination of the Services

• 6.1 The Customer has the right to cancel the Services at any time during the validity of the Agreement. Any monies paid in accordance with the Tariffs are non-refundable.

• 6.2 The Buyer has the right to address the Seller in writing by writing to the support service with a proposal to terminate the Contract. The Contract shall be recognized as valid until its termination by agreement of the Parties.

• 6.3 The Seller has the right to impose restrictions for the Buyer on the provision of Services in case of revealing the facts of unfair use of the Service, namely:

  • a) Use of the Service by the Buyer in order to violate the Legislation of the Russian Federation or other states, as well as unintentional violation of applicable Legislation.

  • b) Use of the Application in a knowingly dishonest manner and not for its intended purpose;

  • c) In case of unfair use of the Application, the Seller reserves the right to terminate the trial period and transfer the Buyer to the full tariff without additional notifications, including in case of detection of repeated use of the trial period.

7. Responsibilities of the Parties

• 7.1 The Buyer undertakes not to use the system for spamming, port and proxy scanning, mass mailing (even if the e-mails are actually sent through another server), not to make hacker attacks on other computers or networks, not to perform other actions with the use of the Application Services that can potentially cause harm to third parties.

• 7.2 The coverage area, internet speed and quality of communication during the provision of the Services may vary for various reasons. The Seller undertakes to make every effort to ensure that the Services are provided at all times (except for technical interruptions). The Services may be unavailable due to circumstances beyond the Seller's control, including emergencies, network problems or limitations, interference, disruption of other related services.

• 7.3 The Seller is not responsible for incorrect display of information in the Application due to network problems. To protect the Buyers, the Seller may unilaterally impose restrictions on the use of certain data, as well as block customer service. The stated network speed is a nominal estimate and may not correspond to the actual speed of sending and receiving data. Actual network speed depends on a large number of factors: configuration, data compression method, network load and others.

• 7.4 The Seller makes no warranty as to the timeliness of data receipt, nor is the Seller liable for any delays or malfunctions.
